Suit wants prosecutor to study Bengals lease



A Colerain Township woman wants Hamilton County Prosecutor Mike Allen to launch an investigation into the validity of the Cincinnati Bengals' lease with the county.

Carrie R. Davis, a legal researcher and consumer advocate, filed a lawsuit in Hamilton County Common Pleas Court on Monday asking that a judge order Mr. Allen to act.

Her filing includes a petition signed by more than 40 Hamilton County residents.

"(Bengals owner) Mike Brown and his involved subsidiaries violated the one and only ... contractual requirement reflecting his corporate promise to Hamilton County residents, specifically to field a viable and competitive major league football team in Cincinnati," the petition states.

The action comes in the wake of concerns from Hamilton County Commissioner Todd Portune about the football team's contract, she said.

Mr. Portune has suggested that the Bengals might be in violation of their lease agreement because of the team's terrible record this season.

In the event Mr. Allen is not made to launch an investigation, Ms. Davis demanded that an independent counsel be appointed to look into the matter.

Mr. Allen could not be reached for comment Monday.
