Lawsuits put blitz on landowners

Hamilton County commissioners filed two lawsuits Tuesday against property owners who are in the way of the Cincinnati Bengals' new riverfront stadium.
The two lawsuits concern property on West Pete Rose Way that's home to Flanagan's Landing, Caddy's Complex and Skyline Chili. Skyline isn't part of the lawsuits because it leases space, and the lawsuits involve only property owners.
'Process is moving forward' "This is the first public indication that the process is moving forward on the Bengals stadium," Hamilton County Commission President Bob Bedinghaus said Tuesday.
The properties sit directly in the path of what will be a reconfigured Pete Rose Way. Ultimately, the road will curve north to accommodate Paul Brown Stadium, scheduled to open August 2000.
There's no question that the county will get the land it needs. The question is how much officials will pay.
Flanagan's owner John Binder said recently that the county had not offered him what he thought the property was worth.
Neither he nor owners of Caddy's or their attorneys could be reached for comment Tuesday.
The civil complaints filed in Hamilton County Common Pleas Court do not offer details about the price the county has offered the landowners or what the landowners want for their property.
John J. Kelley Jr., a lawyer working for the county, said state law doesn't require thatthose figures be included. Including those numbers also could hurt the county's negotiations with the landowners, which are continuing, he said.
"We hope to be able to resolve these negotiations without a trial," he said.
A jury would decide what the county would pay, he said.
Hamilton County Auditor Dusty Rhodes' office estimates the value of the Flanagan's property to be about $1.4 million. A value for the Caddy's property was not available Tuesday evening.
County officials are negotiating to buy all the riverfront land between the John A. Roebling Suspension Bridge and the site of the new football stadium. The stadium will sit between Central Avenue and Elm Street with a curved Pete Rose Way to the north and Mehring Way to the south.
